1. Agreement to Terms
By accessing or using the services of Conway Safety Solutions ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all visitors, users, and others who access or use our services.
These Terms are governed by the laws of England and Wales.
2. Services Provided
Conway Safety Solutions provides professional fire risk assessment and safety consulting services, including but not limited to:
- Fire Risk Assessments for residential and commercial properties
- Compliance audits and regulatory guidance
- Passive fire protection surveys
- Building safety support and consultancy
- Fire safety training and documentation
All services are provided in accordance with relevant UK fire safety legislation, including the Regulatory Reform (Fire Safety) Order 2005 and the Fire Safety Act 2021.
3. Service Booking and Engagement
3.1 Quotations
- All quotations are valid for 30 days unless otherwise stated
- Quotations are based on information provided and site conditions described
- Additional charges may apply if site conditions differ materially from those described
3.2 Booking Confirmation
- Services are confirmed upon receipt of signed agreement or purchase order
- A deposit may be required for certain services
- Confirmed bookings constitute acceptance of these Terms
3.3 Access Requirements
You agree to provide:
- Safe and reasonable access to all areas requiring assessment
- Necessary documentation and information
- Appropriate health and safety information
- Cooperation from relevant personnel
4. Payment Terms
4.1 Fees and Charges
- All fees are quoted exclusive of VAT unless stated otherwise
- Payment terms are net 30 days from invoice date unless agreed otherwise
- Late payments incur interest at 8% above Bank of England base rate
4.2 Payment Methods
We accept payment by:
- Bank transfer (BACS)
- Company cheque
- Credit/debit card (fees may apply)
4.3 Disputed Invoices
Invoice disputes must be raised within 14 days of receipt. Undisputed portions remain payable per standard terms.
5. Cancellation Policy
Cancellation charges apply as follows:
- More than 5 working days notice: No charge
- 2-5 working days notice: 50% of service fee
- Less than 2 working days notice: 100% of service fee
Force majeure events may waive cancellation charges at our discretion.
6. Professional Standards and Liability
6.1 Professional Standards
We warrant that our services will be provided:
- With reasonable skill and care
- In accordance with applicable regulations and standards
- By appropriately qualified personnel
- Within agreed timeframes where specified
6.2 Limitations of Service
Our assessments are based on:
- Visual inspection only unless otherwise agreed
- Information provided by the client
- Conditions at the time of assessment
- Current regulatory requirements
6.3 Professional Indemnity Insurance
We maintain professional indemnity insurance of £2,000,000 per claim. Details available on request.
7. Liability and Indemnification
7.1 Limitation of Liability
To the fullest extent permitted by law:
- Our total liability shall not exceed the fee paid for the specific service
- We exclude liability for indirect, consequential, or economic losses
- We do not exclude liability for death, personal injury, or fraud
7.2 Client Indemnification
You agree to indemnify us against claims arising from:
- Failure to implement recommended fire safety measures
- Inaccurate information provided to us
- Misuse or misrepresentation of our reports
- Breach of these Terms
8. Intellectual Property
8.1 Ownership
- All reports, documentation, and materials remain our intellectual property
- You receive a license to use reports for intended purposes only
- Reports may not be modified, reproduced, or distributed without permission
8.2 Confidentiality
Both parties agree to maintain confidentiality of:
- Proprietary information
- Business processes and methods
- Assessment findings (except where legally required to disclose)
9. Data Protection
We process personal data in accordance with our Privacy Policy and UK GDPR. By using our services, you consent to such processing and warrant that all data provided is accurate.

10. Report Usage and Third Parties
10.1 Report Distribution
- Reports are prepared solely for the named client
- Third-party reliance requires written consent
- We accept no liability to third parties
10.2 Regulatory Disclosure
We may be required to disclose information to:
- Fire and Rescue Services
- Health and Safety Executive
- Local authorities
- Courts or tribunals
11. Complaints Procedure
We are committed to providing excellent service. If you have a complaint:
- Initial Contact: Raise the issue with your assessor or project manager
- Formal Complaint: Submit in writing to info@conwaysafetysolutions.co.uk
- Response: We will acknowledge within 2 working days and respond fully within 10 working days
- Escalation: Unresolved complaints may be referred to relevant professional bodies
12. Force Majeure
Neither party shall be liable for failure to perform obligations due to:
- Acts of God, natural disasters, or extreme weather
- War, terrorism, or civil unrest
- Government actions or regulatory changes
- Pandemic or epidemic
- Other events beyond reasonable control
13. Termination
13.1 Termination by Either Party
Either party may terminate services by giving 30 days written notice, subject to:
- Payment for work completed
- Return of confidential materials
- Completion of urgent safety matters
13.2 Immediate Termination
We may terminate immediately if:
- Payment is overdue by 60 days
- You breach health and safety requirements
- You breach these Terms materially
14. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
We encourage resolution through mediation before litigation where appropriate.
15. Amendments to Terms
We reserve the right to modify these Terms at any time. Changes will be effective:
- For new services: immediately upon posting
- For existing services: 30 days after notification
Continued use of services after changes constitutes acceptance.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
